ONA Settles Two Termination Arbitrations

ONA settled two termination arbitrations, one at American Red Cross and one at Providence St. Vincent. The ARC termination was for an alleged violation of the employer’s attendance policy for an employee already on a final warning for attendance issues. ONA had strong evidence that in the incident that led to the employee’s termination the employer failed to notify the employee of a schedule change, as required by the contract. ARC was willing to put the employee back to work, but the employee decided to negotiate a "walk-away agreement” where ARC agreed to pay the bulk of the employee’s lost wages plus change the termination to a resignation.

The St. Vincent employee was terminated for alleged medical errors, but ONA believed that the termination stemmed from discrimination based on the employee’s national origin. At the very least, it was apparent to ONA that Providence treated this employee differently than similarly situated employees. This employee was terminated whereas other employees who committed medical errors received progressively harsher discipline before termination. The two sides reached a mutually satisfactory resolution of the arbitration and the employee’s pending Federal discrimination lawsuit.
